Maricel’s Kitchen Participant Acknowledgment and Release of Liability
1. Introduction: Maricel’s Kitchen, LLC is committed to providing a safe, enjoyable, and educational culinary experience. Participation in our cooking classes, whether demonstration or hands-on, requires adherence to safety guidelines under the supervision of professional instructors. Your participation is voluntary and for educational purposes only.
2. Assumption of Risk: I acknowledge that culinary activities involve inherent risks, including but not limited to burns, cuts, slips, and falls. I agree to follow all instructions provided by Maricel’s Kitchen staff and to exercise caution and reasonable care during all activities. I am responsible for my own safety and the safety of others around me.
3. Release of Liability: In consideration of my participation, I hereby release Maricel’s Kitchen, LLC, its officers, directors, members, managers, employees, and agents from any claims, liabilities, or damages for personal injury, death, or property damage arising from my participation in the cooking class. This release extends to all activities and risks, known or unknown, associated with my participation.
4. Medical and Dietary Information: I agree to disclose any medical conditions, allergies, or dietary restrictions that may affect my participation in the cooking class. I understand that I am responsible for managing my dietary needs and ensuring the quality of the food I prepare and consume.
5. Media Release: I grant Maricel’s Kitchen, LLC the irrevocable right to use photographs, videos, and audio recordings of me for promotional, educational, and any other similar purposes without compensation. I understand these may be shared on various platforms, including the internet, social media, and in printed materials. I waive any right to inspect or approve the final use of such media.
6. Opt-Out and Privacy: Participants wishing to opt-out of media recordings must notify Maricel’s Kitchen, LLC in writing before the start of the class. We respect your privacy and will take reasonable measures to protect identifiable information when using or sharing photographs and recordings.
7. Participation Terms: Maricel’s Kitchen reserves the right to deny entry or terminate the participation of any individual or group who fails to follow the instructions of our chefs or staff, or who creates an unsafe situation for themselves or others. This policy extends to instances where an individual is unwell, intoxicated, or causing a disturbance that impacts the overall experience of the class or event. Termination of participation under these circumstances will occur without any obligation for reimbursement or compensation from Maricel’s Kitchen.
8. Duration and Revocation: This consent is perpetual and may only be revoked in writing with future effect, without affecting the lawfulness of any use prior to revocation.
9. Minor Participants: If the participant is under 18 years old, this document must be signed by a parent or guardian, who agrees to be bound by its terms. 11. Health Declaration and Indemnification: By participating, individuals affirm they are not currently experiencing symptoms of, nor have they been diagnosed with, communicable diseases such as COVID-19 or the flu, nor have exhibited fever or symptoms in the past 48 hours. While Maricel’s Kitchen takes reasonable measures to uphold the health safety of all participants, the health status of other attendees cannot be fully guaranteed. Participants agree to indemnify and hold Maricel’s Kitchen harmless against any claims or liabilities arising from health issues, including those potentially contracted from other participants during their participation.
10. Agreement: I have read and understood this document, which includes the Hold Harmless Agreement and Media Release. I acknowledge it is a release of liability and a contract between myself and Maricel’s Kitchen, LLC. This agreement is binding on my heirs, assigns, and personal representatives.
The safety and enjoyment of all participants are of the utmost importance to us. We strive to create a respectful and enjoyable environment for everyone involved. We appreciate your understanding and cooperation with these policies to ensure a memorable and safe experience for all.
